Draft law on electronic HR document management was submitted for the consideration of the Russian State Duma. Currently, the Russian Labour Code permits electronic signing only for teleworkers, with specific exceptions. The transition from paper documents and wet signature to electronic format is a long awaited legislative change.
The draft law allows companies to set their own rules for electronic communications and exchange all documents electronically (including employment contracts and separation agreements), without duplication on paper.
Some of the most important documents (employment contracts, resignation notice, warning letter, etc.) require enhanced electronic signatures, while other documents can be signed in the format set by the company. The planned start date of the new regulation is 16 November 2021. Some companies scheduled to draft policies on electronic communications in September-October, so as to implement the new rules as soon as legally possible.
