In their words: “LABLAW successfully assisted Adecco in a delicate litigation, the first of its kind, regarding the ascertainment of legitimacy of a unilateral option – in favor of the employer – to apply the non-competition agreement which was originally undersigned by the employee.”
“This ground breaking case,” explained LABLAW Founding Partner Luca Failla,“commenced when a former high-level employee of Adecco made a claim to be paid extra remuneration upon their departure from the company, due to the constraints put upon them by the Non-Competition Clause, which was in the original employment contract which they signed. The claim was made as the former employee wanted to work for a competitor – but was unable to as it was a violation of their employment agreement with Adecco. The former employee won an earlier legal challenge on this front – but LABLAW overturned this original judgement in the Italian Supreme Court – setting a new legal precedent.”
“This was the first time the law on Italian Non-Competition Clauses (ex art. 700 c.p.c. del 24/2/1999) was challenged in this way, since it was introduced 19 years ago,” continues LABLAW Founding Partner Francesco Rotondi. “The ruling made by the Italian Supreme Court on this case has provided businesses operating in Italy with a concrete defence to protect their know-how in case their employees look to work for competitors in the future.
