Van Olmen & Wynant (L&E Global Belgium), together with the Belgian Institute for Company Lawyers (IJE | IBJ), recently hosted a successful bilingual (Dutch and French) Employment Forum, attended by some 60 HR managers and in-house counsels. The Forum took place at the Headquarters of Proximus, Belgium’s largest telecommunications company and a loyal client of Van Olmen & Wynant.
Following an introduction by Chris Van Olmen (founding partner of Van Olmen & Wynant and head of the employment law practice) the forum focused on the important topic: “Employment contracts in the public sector: on the crossroad of public and private law.”
The Belgian public sector has significantly increased its employment of contractual employees instead of appointing statutory civil servants, thanks to the more flexible nature of the former. However, it is not always clear which rules are applicable to the contractual employees, as some sections of the general employment legislation apply only to the private sector.
Vincent Vuylsteke (Partner at Van Olmen & Wynant and expert in public sector employment law) gave an overview of the different employment systems (statutory vs. contractual), explained the issues regarding the recruitment of contractual employees, and talked about the do’s and don’ts during the execution of the employment contract. The theory was supported by practical information and examples presented by Olivia Rolin, the experienced legal manager of Proximus.
In addition, dr. Stephanie De Somer, Of Counsel at Van Olmen & Wynant and FWO post-doctoral researcher at the University of Antwerp, outlined the major discussions concerning the dismissal of contractual employees by public sector employers.
Vincent Vuylsteke and Olivia Rolin concluded the forum by providing the audience with some practical tips.
